HMRC Confirm new brief on B3A
Machines |
 |
|
Following a recent Tribunal case
(supported by BACTA) HMRC has published a business brief acknowledging
that they will be accepting claims from stakeholders who paid AMLD on
B3A automated lottery machines from 21st July 2009 onwards. |
 |
|
The Tribunal found that from 21st July
2009 onwards, B3A automated lottery machines are not “amusement
machines” for the purposes of AMLD and therefore no duty should have
been paid. Businesses will be pleased to hear the HMRC have now
confirmed that they do not intend to appeal against the Tribunal’s
decision and are inviting claims to recover AMLD that has been paid on
these machines. |
 |
|
A copy of the brief can be found on
HMRC’s website:
www.hmrc.gov.uk/briefs/excise-duty/brief3311 it includes the
following guidance: |
 |
• Whilst HMRC o not agree with the
Tribunal’s decision, they will accept the decision.
• HMRC will accept claims for AMLD that has been overpaid since 21st
July 2009.
• For licences that span 21st July 2009, HMRC will calculate the
repayment by reference t the number of days that the licence was not
required (i.e. from the 21st July 2009 onwards) compared to the total
length of the licence.
• HMRC will enforce assessments that have been raised for the period
before 21st July 2009.
• When making a claim, you should include full supporting evidence of
the licence. This should include the licence number, the date covered
by the licence and the amount of duty paid. If you are claiming for a
refund for a current licence you must send the licence with the claim.
Claims should be sent to: |

4th January 2011 |
VAT Increase to 20%
In his 2010 Emergency Budget, the Chancellor announced an increase in
the standard rate of VAT from 17.5 per cent to 20 per cent effective
from 4th January 2011.
For equipment that is invoiced for rent only, either by regular
collection, monthly invoice or standing order, if the date of the
invoice is on or after the 4th January 2011, the VAT rate will be at
20 per cent.
All standing order customers should have already received a form to
amend their payment in January 2011. This form will need to be signed
and returned to AMS as soon as possible. If you have not received this
form please contact us at the office on 01959 564331.
For any equipment that we regularly empty and complete a tax
collection receipt, you will see that the net amount will be
apportioned between the old and new rates of VAT due to the collection
period spanning the rate change date. Any rental amounts shown on this
type of receipt, will have the VAT rate at the date at which the
invoice has been raised, so if on, or after 4th January 2011, this
will be at 20 per cent.
If you have any queries regarding this matter please feel free to
contact us on the office telephone number 01959 564331. |

2010 Heineken UK
Kent, Sussex and Essex Business Fair
Today we exhibited a
selection of our products to attendees of the 2010 Heineken Business
Fair at Crayford Greyhound Track. This was a great opportunity to
catch up with existing customers and introduce ourselves to potential
new customers as well as detailing some of the features of the latest
products in our range. Many other well know industry suppliers were
also exhibiting and feedback from the attendees was excellent.
AMS sponsored the very first Greyhound race of the afternoon but
unfortunately none of our staff backed the winner!
We hope everyone who attended enjoyed the day and we look forward to
supporting this great event next year. |

Multi-Game
Quiz – SWP Compliance
As from today, Monday 1st November 2010, the
new guidelines for all content available for
play on all Multi-Game Quiz - SWP machines
came into force.
These new guidelines were compiled by the
Gambling Commission and Her Majesty’s Revenue
and Customs and all manufactures of these
types of machines have issued vital software
updates to ensure their products comply with
the new criteria.
As a result a number of games have been
modified and a small number have had to be
removed. In most cases additional new games
have been installed to increase player appeal.
Automatic Machine Services Ltd are committed
to meeting all industry guidelines and as such
have completed a large updating programme to
ensure all of our machines that required
software updates were completed prior to
today’s deadline date.
